Time line of Government deceit part 2 Sunshine Law-Violation

On December 19th 2007 (it happened again), in the hearing room of The Miami-Dade County Construction Trade Qualifying Board; a breach of Florida Sunshine Law occurred. Before the start of The Board meeting, three Board members and a citizen from the organization International Brotherhood of Workers, Mr. Bill Ryley, were caught on tape, discussing issues pertaining to Board rulings in private.

Their actions were in direct conflict with State Law; prohibiting elected or appointed officials from discussing Public business in private. The Board members  obviously were not supposed to be engaging in such conversations, prior to full Board hearings. Mr. Wilson, overheard the content of their private conversations as he filmed their actions.

The Citizens, (as seen in the video) were arguing his position, seeking individual Board member support. To change The Boards  previous decision of excepting a  plea of guilty from individuals found to be in possession of an illegal Contractor’s license, without providing an explanation as to how they obtained the illegal license to a plea that would require an explanation.

This citizen was dissatisfied with the plea agreement. The Board granted violators, and so he decided to approach individual Board members to lobby his position in private. If a Citizen had something to say pertaining to The Board’s decisions, they are required to sign the appearance log, wait until the hearing/proceeding starts, approach the podium, then make their concerns known to the full Board, in open view of the Public. Not in a private huddle with selective Board members and The Board’s Attorney (like a lobbyist).

In an unrelated matter, Mr. Rosenthal made his role as Board counsel pencil clear. He stated, ‘As Board council his sole responsibility is to provide legal advise to The Board, not to the Public.

But as you will clearly see in The CSB News Timeline News clip, Mr. Rosenthal’s duties radically changed, as it would appear. The Good Ole Boys special interest groups almost always get behind the scenes prying advice and consideration from our elected officials or appointed Board members on issues of Public matters before the issue ever reaches the floor for Public discussion and Review.

According to Assistant County Attorney Sean, CTQB hearings are ‘Quasi-Judicial proceedings and the Public is not permitted to participate or speak.

Mr. Rosenthal goes on record to explain:
The CTQB hearings are Public proceedings rather than a Public hearing (CTQB hearings are not like the Board of County Commissions hearings) ‘It is up to the chair,’ he stated ‘to decide if the Public would be allowed input, or participation in the Public proceedings’ (not so states Florida Sunshine Laws).

It therefore stands to reason, that Board members that converse in private with individuals who have an interest in Board decisions, do this before the formal hearing begins, because the CTQB is a Public proceeding and not governed by public hearing laws...right?...wrong!

Florida Law is quite clear on issues concerning Public hearings, but in an effort to sidestep Florida Law, (which guarantees Public participation in Public hearings) Local Government with the assistance of its Lawyers have created procedures to silence the Public.

The Miami-Dade Couty Construction Trade Qualifying Board members and counsel are operating what would otherwise be a Public hearing proceeding, as if it is a closed door session, calling it a Quasi-Judicial proceeding in order to block Public participation. (see video)

Quasi-Judicial proceedings really mean the CTQB has structured its hearing proceedings similar to that of a Judicial nature, period. There is no sharing of Judicial powers or authority with the Legislative Board, which is very much unconstitutional. It all goes back to that thing called, conflict of interest, and Miami-Dade County CTQB, is in fact presently engaging in a conflict of interest, by hearing illegal Contractor’s License cases. MDC BCCO’s inconsistent case rulings, bad cop-good cop scenarios, code violations, pleas of guilty, refusals to ask for explanations of guilt, as to how they obtained their illegal Contractors Licenses is a travesty of justice. These violators are treated as though they were innocent. These illegal contractors are given reduced fines and a payment plan.
But in comparison, Afro-American Contractor’s with legitimate Contractor’s Licenses are not given reduced fines and are not given payment plans. In fact their Contractor’s Licenses are revoked, and to add insult to pain, are not allowed to speak on the facts and circumstances surrounding the code violations which involves members of the Board’s staff.
